The Ad World Masters website at https://www.adworldmasters.com (hereinafter “ADWM”, “we”, “us” or “our”) is owned and operated by ADWM Ltd, a company registered under the laws of Ireland with Irish Company Registration Office (CRO) Identification Number 634258 ; and operating from Bolton House, Aughrim Lane Business Complex, Aughrim Street, Dublin 7, Ireland.
PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCESSING OR USING THE ADWM WEBSITE. BY ACCESSING OR USING THE ADWM WEBSITE, YOU CONFIRM THAT YOU ARE AT LEAST 18 YEARS OF AGE AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU ARE ADVICED NOT TO CONTINUE USING THIS WEBSITE ANY LONGER. AD WORLD MASTERS MAY MODIFY THESE TERMS AND CONDITIONS AT ANY TIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE SAME ON THE WEBSITE. ADWM is an online platform that provides a unique global ranking of advertising and marketing agencies, design studios and other creative firms (hereinafter “Agencies”), aiming to connect them professionally with relevant market users (hereinafter “Marketers”) through an advanced use of data and technology. This is made possible thanks to ADWM’s unique scoring algorithm which assesses a wide variety of data to score an Agency on a scale from 0 to 10. ADWM also offers additional features to Agencies such as self-serve advertising within 2 types of placements, namely “Featured Agency” and “Agency Of The Month” and a “Premium” paid membership unlocking extra functions for actively prospecting agencies.
Please note the ADWM platform merely acts as a tool for Marketers to discover and connect with Agencies and vice versa. ADWM does not own or control any information provided in any Agency Profile and does not warrant any successful business agreement between Marketers and Agencies from the mere usage of the ADWM website and its offered services.
In these Terms of Service, unless otherwise stated:
- "Ad World Masters", “ADWM”, "We", "Our" and "Us" refer collectively to ADWM Ltd and its subsidiaries, affiliates, directors, officers, employees, agents and contractors.
- "User", "You" or "“Your" refer to the person, company or organization that is visiting, using or accessing the ADWM website. The term User is equally applicable to an Agency, a Marketer, or an unregistered visitor.
- "Agency" refers to a registered service provider using ADWM services to connect to Marketers.
- "Agency Administrator" refers to the one Agency User, human person among the Agency's subsidiaries, affiliates, directors, officers, employees, agents and contractors who is the main entitled person to manage the Agency Profile.
- “Agency Manager” refers to an Agency User that has been granted by the Agency administrator rights to manage the Agency Page.
- "Agency Profile", “Agency Page” refers to the Agency's Site page that may be consulted by registered or non-registered users.
- “Agency Score” or “Score” refers to the score an agency is given by ADWM scoring algorithm, which is between 0 and 10.
- “Agency User” refers to a human person registered user of the platform which identified himself as related to agency and created an “Agency Account”.
- “Agency Of The Month” refers to a specific advertising placement which is only available to Agency Profiles which scores among the best (currently 8.5 and above).
- “Advertising system” refers to the self-serve advertising system available for Agencies through the ADWM platform.
- “Basic”, “Basic profile””Basic membership” refers to an agency profile which has no premium subscription associated to and is not eligible for premium services and features.
- “Featured Agency” refers to a specific advertising placement for Agency Profiles.
- “Marketer” refers to a registered user making use of ADWM services to search and contact Agencies.
- "Marketer Account" refers to a type of user account with specific features dedicated to Marketers.
- “Moderator” refers to a human person affiliated with ADWM which acts on the platform on the behalf of ADWM following those terms and conditions.
- “Premium” refers to an available subscription option for Agency Profiles which unlock extra features for actively prospecting agencies such as Statistics and Agency Score Badge.
- "Services" refers to the Platform and to any other services or products offered by ADWM on or through the Site.
- "Site", “website”, “platform” refers to Ad World Master’s website located at https://www.adworldmasters.com, all subpages and sub-domains, and all content, services, and products available at or through the Site.
In order to use the ADWM services as an Agency, you must register and create join or claim a profile (the "Agency Profile"). ADWM requires you to provide personal information including your full name, company name, company address, year of foundation, types of services provided, number of employees in the company, and any additional information which characterize the company. ADWM may ask you to submit additional identifying documents to confirm your right to be Agency Administrator of an Agency profile.
ADWM reserves the right, in their sole discretion, to accept or reject your registration to use the Services. ADWM also reserves the right to deny your right to claim an agency and become Agency Administrator of a certain Agency Profile if we have reasonable grounds to suspect that information you provided is not true or not sufficient.
A profile on behalf of an Agency (Agency Profile) may be initiated by any registered User, provided they only supply information they have knowledge of and believe to be true about the Agency. Agencies may have one or more Agency Managers who are given all rights to edit the Agency Profile and to Advertise and use Premium Subscription on behalf of their Agency. Agency Users may be Agency Managers or Agency Administrator of one or more agencies if they can prove to be a legitimate representative of each Agency. ADWM do its possible to ensure data about agencies is correct but ADWM has no obligation to verify the information entered by a User about an Agency. The user initiating an Agency Profile cannot be a verified Agency Administrator without submitting supporting documentation. An “unclaimed” / “unverified” Agency Profile is a profile that has not been claimed or verified by an official representative of the said Agency. Agency Profiles may be claimed and verified by official agency representatives through social media authentication and/or verification by ADWM Moderator. After verification, the agency representative will become the Agency Administrator of this Agency Profile, and can henceforth check and modify the information entered previously by the user who initiated the Agency Profile. During the verification process, if there is any suspicion in the reasonable opinion of the ADWM Moderator about the submitted information being fake or abusive or incomplete, the Moderator may require additional information or evidence and the Agency will remain “claimed” but “unverified” until requested information or proof has been given by the Agency Administrator to the Moderator. In order to delete an Agency Profile, the Agency Administrator can either delete through its dashboard or send a deletion request via email at firstname.lastname@example.org along with suitable reasons for the deletion.
In order to use ADWM as a Marketer, you must register and create a profile (the "Marketer Profile"). ADWM requires you to provide personal information including your full name, company name, company address, company registration number, year of foundation, types of services provided, number of employees in the company, and any additional information which characterize the company. Each Marketer Account must be used by only one human person, and each human person can use only one Marketer Account.
ADWM will review the information during the registration process and any other information that is publicly available. ADWM reserves the right, in their sole discretion, to accept or reject your registration to use the Services.
The “ADWM Agency Score” uses data and technology to assess the potential of an Agency within the market and compare it to other Agencies. All users should acknowledge and understand ADWM Agency Score as an experimental tool and not directly a proof of an agency performance or capabilities. ADWM does not guarantee, endorse or discriminate Agencies basing on this score or the display of this score. Agency Profile information is used to determine the Agency Score based on a scale from 0 to 10 which estimate the potential of an Agency regarding various factors including but not limited to Agency details, Awards, Reviews, Social Media, Specialization, Website performances etc. This Agency Score is calculated by ADWM scoring algorithm and cannot be altered manually. Agency Scores depend largely on the input data fed by the User who initiated the Agency Profile. In order to ensure that all Agency Scores are reliable to the maximum extent, the ADWM Moderator may ask for additional verification by submission of supporting documents. Agency Profile that are “unverified” and “unclaimed” have their Agency Score displayed in a lighter shade of colour and a disclaimer indicating that the score is a rough estimation and subject to change.
The ADWM advertising system is a self-serve advertising system for promoting Agencies using data from the Agency Profile. There are two types of ADWM advertising placement: “Featured Agency” and “Agency of the Month”. Featured Agency is an advert placement that shows the Agency Profile as a featured entry within the ranking. Agency Of The Month is an advert placement dedicated to the best Agency on the platform with a score of 8.5 or higher.
The advertising system works on a Pay-per-impressions principle. The Agency Manager can set up a campaign and decide the number of impressions he is willing to purchase for this campaign. Targeting options are available to make adverts appears to audience which match the agency’s potential prospects.
An impression is counted each time an advert is shown on the screen of an ADWM user corresponding to the targeting decided by the Agency Manager whom set the campaign. Once all the impressions are counted down to 0 the campaign is over and the advert will not be shown any longer.
Once purchased, the advertising campaign cannot be refunded. The price for advertising is fixed for 1000 impressions. ADWM reserves the right to change this price anytime at its sole discretion. ADWM do not in any way guarantee the efficiency of the advertising or reach of any marketing or advertising goal while using this service.
Marketers have the opportunity to post reviews on the Agency Profile about Agencies they have worked with. The review is composed of a written account of different aspects of the work provided by the Agency along with the identity of the Marketer posting the review. Marketers can and should only post one review per Agency. The review should be honest and concerned only about the activity of the concerned Agency. ADWM reserves all right to remove reviews, which in their sole discretion, are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service and/or undermines the working of the Agency and ADWM. Reviews may be edited by Marketers if needed.
Agencies may choose to post appropriate reply to such reviews and should observe same rules regarding posting. Reviews that are violating any law and/or these Terms of Service should be reported immediately.
ADWM is not liable under any circumstances to any user for any User content submitted, posted or transmitted by any other User, even if that content violates these Terms of Service or other policies stated anywhere on our Site, and ADWM may, but is not obligated to take any action to remove that content or terminate that User's account;
Your ability to use the ADWM Services is a privilege, not a right, and we reserve the right to take any action that we deem proper, without notice, to prevent any violation, enforce any provision, or rectify any alleged violations, of these Terms of Service or any applicable law at our sole discretion.
As a registered user (marketer or agency). You agree to receive email notifications informing you about activity on your account. These notifications are sent automatically and cannot be deactivated. A user may choose to change the frequency of email notification sent (daily, weekly, monthly) from its dashboard. Your only recourse to not receiving these notifications is to resign from the service.
Agency Managers can subscribe to a Premium membership for an Agency Profile. This subscription is paid annually and grants one year (365 days) of Premium services which not only allows the Agency to access more information regarding its potential prospects through detailed statistics, but also to showcase their score using a dedicated Agency Score Badge (a widget working with a dedicated API which allow user to showcase their score wherever HTML code can be inserted). Agency profiles which have no Premium subscription associated (Agency without access to Premium features and services) are designated herein after by “Basic”. Access to Basic services is currently free of charges but ADWM reserves the right to change it at any time.
If you sign up for a Premium Subscription, you will be billed on a yearly basis. An upgrade from the Basic membership to Premium membership will end your free membership. You will be billed for your first year immediately upon upgrading.
The Service is billed in advance on a yearly basis and is non-refundable. There will be no refunds or credits for partial years of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made. If you downgrade your subscription to Basic Subscription prior to the processing of your next year’s invoice on the 365th day, you will not be charged for the next year.
We reserve the right to change membership fees, service fees, processing fees or any other fee that may be charged by ADWM at any time, at the sole discretion of ADWM and upon reasonable notice posted in advance on the ADWM website. No refunds of fees already paid will be given.
Fees for Premium Subscriptions are automatically charged on a recurring basis, and when signing up for a Premium Subscription with a recurring payment obligation, unless you cancel or change your Subscription in accordance with these Terms of Service, any Subscriptions you have signed up for will be automatically extended for successive renewal periods of the same duration as the Subscription originally selected, at the then-current non-promotional rate. By signing up for a Subscription, you agree that we may submit the charges associated with such Subscription for payment on the applicable schedule and you will be responsible for such charges. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially selected to use the Premium Service and/or Subscription. This does not waive our right to seek payment directly from you.
We use a third-party payment processor (the "Payment Processor") to bill you through a payment account linked to your Account on the Services (your "Billing Account") for use of the Premium Services. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms of Service. We are not responsible for error by the Payment Processor. We reserve the right to correct any errors or mistakes that the Payment Processor makes even if the Payment Processor has already requested or received payment. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit/debit card issuer, or other provider of your chosen Payment Method. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand.
Current Information Required
You must provide current, complete, and accurate information for your billing account. You must promptly update all information to keep your billing account current, complete and accurate (such as a change in billing address, credit card number, or credit card expiration date), and you must promptly notify us or our payment processor if your payment method is cancelled (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of your account credentials or password. Changes to such information can be made directly by you using the service. Please contact us at email@example.com if you need any assistance. If you fail to provide any of the foregoing information, you agree that we may continue charging you for any use of premium services under your billing account unless you have terminated your premium services as set forth above.
Cancelling or Changing Premium Subscription
To change or resign your Premium Subscription at any time, go to Account settings. Please contact us at firstname.lastname@example.org if you need any assistance. Any request for cancellation must be sent three (3) business days prior to the end of the Subscription term to allow for adequate processing time. Your non-termination or continued use of the relevant Premium Service reaffirms that we are authorized to charge your Payment Method the Fees for such Premium Service, including any associated fees (e.g. overage fees or late fees, to the extent applicable). If you terminate a Premium Service, you will be downgraded to the "Basic" plan level at the time of your termination; your paid Subscription will not be renewed. You will not be eligible for a prorated refund of any portion of any Fees paid.
Change in Amount Authorized
If the amount to be charged to your Billing Account varies from the amount you preauthorized, you have the right to receive, and we shall provide, notice of the amount to be charged and the date of the charge before the scheduled date of the transaction. Any agreement you have with your payment provider will govern your use of your Payment Method. You agree that we may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle.
Once initiated by you, payment obligations are non-refundable. Except as expressly set forth in these Terms of Service, ADWM will not, under any circumstances, issue refunds or pro-rate any Fees for early cancellation or termination of the Services, or for any other reason, including for any unused Services or if your actual usage of the Services falls below the purchased amount applicable to your Subscription level for the Services. Subscription quantities cannot be decreased during the relevant Subscription term.
Chargeback Policy & Disputes
If you have a question about charges made to your Account, please contact us immediately. If the charges were made in error, we will credit your Billing Account or Payment Method for the appropriate amount, after verifying this case. Please note that ADWM has a zero-tolerance policy for chargebacks. Any user who disputes a credit card payment that is found to be valid can be permanently banned from use of any and all ADWM Services.
Free Trials & Other Promotions
Any free trial or other promotion that provides access to a Premium Service must be used within the specified time of the trial. Unless specified otherwise, free trial is granted for one year and will be accessible only for a limited number of premium subscribers on a first-come first-served basis. Only one free trial can be granted per person and per Agency Profile. You must stop using a Premium Service before the end of the trial period in order to avoid being charged for that Premium Service. If you cancel prior to the end of the trial period and are inadvertently charged for a Premium Service, please contact us at email@example.com. Sales promotion may occur throughout the year through discount code that allows potential subscriber to get a discount on his first year of premium service subscription. Discount codes must be used within the specified time they remain valid.
Modifications in Fees, Billing and Payment Methods
ADWM reserves the right at any time to modify its prices including subscription and advertising or promotion, and any other fees (including charging for services which until then were free of charge).
ADWM reserve the right to change billing, invoicing methods and the payment methods available for the Services, at any time either immediately upon posting on the Site or by notifying you by email.
At ADWM entire discretion, old prices, promotions and any other fees may be discontinued in unless otherwise stated.
You can cancel your account at any time through the website or by sending an email to firstname.lastname@example.org with the email you registered to ADWM explaining the reason of the cancellation, you may be asked to prove your identity to be able to cancel your account via email.
If you cancel the Services before the end of your current paid subscription or advertising campaign, your cancellation will take effect immediately and you will not get refund for the current paid period or advertising campaigns; you will not be charged again for upcoming periods.
ADWM, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Services, for any reason at any time, with or without cause, with or without notice.
ADWM reserves the right to refuse the access to the Services to anyone for any reason at any time.
You acknowledge and agreed that ADWM will not have any liability whatsoever to you for any suspension, cancelation or termination.
Termination of your relationship with ADWM does not affect your relationship with any other User or entity using or having used the ADWM Services. All legal, contractual and ethical duties, obligations and responsibilities survive termination of the ADWM relationship.
All provisions of these Terms of Service which by nature should reasonably survive termination will survive termination, including, but not limited to, invoicing terms and costs, ownership provisions, warranty, disclaimers, indemnity and limitations of liability.
